The Provider: Polly’s Photo Booth Hire
The End User: Customer/Client
The parties, for Photo Booth services during the designated period. The following contract and its terms comprise an agreement between the Provider and the Customer for the hire of any photo booth package, this written contract sets out the full, intentions of the parties and supersedes any previous written or oral agreements made between the parties.
Service Period the agreed runtime of the chosen package
Start Time: Beginning of Runtime.
End Time: Finish of Runtime
Date: Is the date of event confirmed via the booking confirmation form.
The Provider agrees to provide the agreed booth and package, and to ensure it is operational and available for use for a minimum of 80% of the agreed service period, to permit maintenance of the Photo Booth should any be necessary.
A non-refundable deposit set by the provider is required to secure any booking. The balance of the agreed rental package can be paid anytime and payment in full is required no later 10 days before the Customer’s event. If the provider uses the equipment for a period in excess of the agreed service period additional rental charges will be payable by the Customer to the Provider, calculated on a pro rata basis.
Payment of all additional rental charges must be made by the Customer before any additional service period commences.
Methods of Payment
Methods of payment accepted are as follows, Bank Transfer or debit/credit cards, (may incur a surcharge) but must be paid before the hire starts.
Access, space & power requirements
The Customer will arrange for an appropriate space to be made available for the designated booth (details of requirements will be provided by the provider) at the event venue. A minimum floor area will be required.
The Customer will ensure the venue provides a mains electricity supply comprising a double 13amp socket located no further away than 2 meters.
It can take us anywhere from 40-60 minutes to set up, we will arrive on site at least one hour before your hire time is due to start, this time is included and is not counted as part of your run time. Sometimes it not always possible to set up or break down the booth directly before or after an event. For example, if you require the booth setting up at 6pm but do not want it running until 9pm, this would be charged at 3 idle hours on top of the hire costs. Idle hours are charged at £25 per hour.
Date changes & cancellations
Any request to alter the agreed date of the rental package must be made in writing and at least thirty days prior to the Customer’s event.
Any change of date is subject to the availability of the designated booth on the alternative date and receipt of a new booking contract.
If the Customer cancels an agreed rental package up to thirty days before the rental date and have paid the balance or paid any amount above the initial secure deposit a refund will be issued minus the non-refundable deposit.
If the Customer cancels an agreed rental package within thirty days before the rental date, the full amount will be forfeit. Full amount is still payable if it has not been paid, this is something we take very seriously, and will pursue payment.
The procedure is as follows for cancelling a booking, send an email to firstname.lastname@example.org, we will then reply to you with details of any monies owed to us if any. Please note this is the only form of cancellation that we accept, we do not accept Phone Calls, Text Messages, Voice Mail Messages, or Facebook Messages.
A minimum of a non-refundable deposit set by the provider is required to confirm any booking, with the total balance to be paid no later than ten days before the event. A 5% discount is available for immediate payment in full and will be refundable minus minimum deposit if booking is cancelled up to thirty days before event.
Loss or damage to providers equipment
The Customer assumes complete responsibility for any loss of or damage to the Provider’s equipment (other than fair wear and tear) caused by any misuse of the equipment by the Customer, their employees or their guests.
The Customer shall be responsible for any loss of or damage to the Provider’s equipment caused by Theft, Fire, Flood or Accidental Damage.
The Customer agrees to, and understands the following:
- a) The Customer will indemnify the Provider against any and all liability related to the Customer’s Event and use of the Provider’s equipment.
- b) The Customer will indemnify the Provider against any and all liability associated with the use of any pictures taken at the Customer’s event by any booth or by its operative’s employees or affiliates.
The Customer agrees to, and understands the following:
All persons using the designated Booth at the Customer’s Event hereby gives Polly’s Photo Booth hire the right and permission to copyright and to reproduce or otherwise use any photographic portraits or pictures of any booth user who may be included in whole or in part, via any or all media now or hereafter known for illustration, art, promotion, advertising, trade, or for any other purpose.
In addition, the Customer, hereby releases, discharges and agrees to maintain Polly’s Photo Booth hire free from any liability arising out of the taking of said picture or any subsequent processing or publication thereof including, without limitation, any claims for libel or invasion of privacy.
If any provision of these terms shall be unlawful, void, or for any reason unenforceable under contract law, then that provision, or portion thereof, shall be deemed separate from the rest of this contract and shall not affect the validity and enforceability of any remaining provisions, or portions thereof.
This is the entire agreement between the Provider and the Customer relating to the subject matter herein and shall not be modified except as agreed in writing by both parties.
In the unlikely event that it is not possible, other than for reasons beyond the Provider’s control, to provide an operational Photo Booth for at least 80% of the agreed service period, the Provider shall make a refund to the Customer as per our current hire prices, example, three hours hire of the Magic Mirror £499.99 only usable for two hours refund of £20 as two hours for mega booth is £479.99
Where the rental includes a photographic printer and for any reason printed photographs cannot be provided on site at the time of the event, the Provider will place the photographs on a web site which the Customer and their guests can access and download.
If no service is received, the Provider’s maximum liability will be the return of all payments received from the Customer. This payment will be made no later than 21 days from the date of the event. The Provider is not responsible for any consequential damages or lost opportunities upon breach of this agreement.
